The maximum authorized weights and dimensions for vehicles in use
The European Union has devoted itself, within the framework of the Common Transport Policy, to the regulation of international traffic, with a view to harmonizing the rules of all Member States in this regard. In fact, this concern has resulted in extensive legislative production by the bodies of the European Union in this area, introducing common rules that aim to allow better use of road vehicles in traffic between Member States, although it is certain that any differences, in particular, the weight and dimensions of commercial road vehicles can have unfavorable effects on competition conditions, constituting an obstacle to inter and intra-Member State traffic.
With regard, in particular, to the subject now analyzed, the European Union produced Directive 96/53 / EC published on 25 July 1996, which established the maximum authorized dimensions for national and international traffic and the maximum authorized weights for international traffic. for commercial road vehicles transporting goods in the Community. This diploma was transposed into the Portuguese legal order through Ordinance No. 682/96, replaced by Ordinance No. 1092/97, of 3 November, which, in turn, was amended by Ordinance No. 960/2000 , of 9 October.
Directive 96/53 / EC was amended by Directive 2002/7 / EC of 18 February 2002, adding the maximum dimensions authorized for road passenger vehicles. This diploma thus began to regulate the issue for most vehicles.
Following Directive 2002/7 / EC, the Portuguese State chose to transpose this amendment by promulgating, very recently, a single diploma that also provides for matters relating to goods and passenger vehicles, unifying this matter in a single instrument, the “Regulation that sets the maximum authorized dimensions and weights for vehicles in circulation ”(hereafter the Regulation).
This Regulation thus starts to prescribe the maximum dimensions and weights of goods and passenger vehicles. It should also be added that the Decree-Law places some types of vehicles outside the scope of the Regulation, namely military vehicles.
Therefore, the aforementioned Regulation was approved by Decree-Law No. 99/2005, published on June 21, 2005, which transposed the aforementioned Directive.
Since it was intended to unify these matters in a single legal instrument, this Decree-Law also revoked Ordinance No. 1092/97, of 3 November, which already established the parameters relating to goods vehicles.
In fact, we can see that, more than a real substantial change, the legislator made a formal change, with a view to improving the legislative technique, which translated into a new systematization of the rules in question, trying to simplify the legal complex that regulates this matter.
It is, therefore, an innovative legislative technique, so there is no significant change in the current rules, with rare exceptions, among which we highlight the differentiation of weights when transporting ISO 20 'containers.
